Mr Gombe had written a letter to the chief judge of the Federal High Court on May 4, requesting that the case be transferred to another judge.
Mr Tsoho, in a statement on Monday, said he would honour the invitation as soon as his lawyer, Kanu Agabi, completes his medical treatment abroad.
Mr Ejimakor said Mr Kanu’s legal team received the “momentous and somewhat pyrrhic” letters when they visited him on Friday.
“This will enable us to harness the collective wisdom and expertise of all key players in the sector.
The Federal High Court chief judge, John Tsoho, has ordered the reopening of the Benin City division of the court for proceedings.
The Federal High Court will begin its Easter vacation on March 31.
