Kaduna court reverses self on order to evacuate El-Zakzaky’s wife from prison

A High Court in Kaduna has made a U-turn on its order directing the Nigeria Correctional Service to release Zeenat El-Zakzakay, wife of the embattled leader of the Islamic Movement of Nigeria (Shiites) for COVID-19 treatment.
The court revoked it’s directive after a member of the defence counsel, Harauna Magashi told the court that Mrs. Elzakzaky has regained her health.
Justice Gideon Kurada Tuesday, ordered the release of Mrs. El-Zakzaky on the occasion of her testing positive for COVID-19.
The order came after her lawyer, Femi Falana, presented a medical report to the court, praying the court to allow his client to get medical attention outside the correctional center.
The court granted the prayer of Mr. Falana by directing the correctional center to release Mrs. El-Zakzaky for treatment in line with COVID-19 directives.
“Upon an oral application moved by H.G. Magashi, Esq. holding the brief of Femi Falana SAN, counsel for the 1 defendant and of Edwin Inegedu, Esq. of counsel for the 2nd defendant applying for an order vacating an earlier order made on 26th January 2021 for 2nd defendant to be taken to a government hospital for treatment.
“The situation has changed as the 2nd defendant regained her good health and the unfettered access to medical facilities granted her by the correctional services centre, Kaduna,” the Judge said in a ruling on Thursday.
“It is hereby ordered that the application is granted and the order of court made on 26 January 2021 is hereby vacated,” the Judge directed.
Mr. El-Zakzaky and his wife have been in prison since 2015 following a clash between his followers and soldiers in Kaduna state.
He is currently being charged with homicide, unlawful assembly, and disruption of public peace among others.
