Mr Olukoyede,’s lawyer, Olumide Fusika, SAN, challenged the legal authority of the plaintiff to institute the suit in the first case.
The assembly impeached the former deputy governor over allegations of financial recklessness, misconduct and insubordination.
The sacked local government chairmen and councillors had, in 2021, gotten a judgment of N4,874,889,425.60 against the governor.
The plaintiff and lawyer, Mr Victor Opatola, chose to represent himself in the suit.

At issue was the failure of the federal government to honour the first tranche of $159 million promissory note due for payment on October 15, 2022.
Mr Nwajagu had, on Tuesday, prayed the court to admit him to bail on liberal terms.
