Mr Akeredolu had, in July, similarly written to the legislative to request medical leave and returned to the country on September 7.
He also refused to grant Mr Akeredolu and the speaker’s request to strike out or dismiss the suit for lack of jurisdiction.
This comes less than a week after the assembly announced the suspension of the impeachment process against Mr Aiyedatiwa.
The Ondo State House of Assembly had served Mr Aiyedatiwa notice of impeachment over allegations of gross misconduct.
They also demanded that the governor “resume or resign” within the next three days and cease governing the state by proxy.
The Assembly had served the deputy governor 14 allegations of gross misconduct amid his impeachment plot.
The State House of Assembly, through its counsel, Femi Emodamori, stated this on Monday.
Mr Olajidi later vowed that the assembly would proceed with the legislative process against Mr Aiyedatiwa to a logical conclusion.
Mr judge, who granted all the reliefs, adjourned the matter until October 9 for a hearing.
The Nigerian Constitution allows Deputy Governor Lucky Aiyedatiwa to continue to act as governor until Mr Akeredolu returns and notifies the parliament.
