Messrs Omo-Agege and Efemana of the Federal Ministry of Agriculture and Food Security were billed to take their plea on alleged fraud to the tune of over N40 million.
The Federal High Court, Abuja Division, on Wednesday, struck out the lawsuit filed by former Deputy Governor Lawrence Ewhrudjakpo.
Mr Jonathan earlier said he would commence consultations concerning the possibility of contesting presidency in 2027.
Responding, defence counsel, E. E. Ekere, said he was unaware of the allegations raised by the prosecution.
After the judge heard the plaintiff’s opposition to the preliminary objection, the judge adjourned the matter until May 26 for a composite judgement.
The ruling comes shortly after former Vice-President Atiku Abubakar called for Mr El-Rufai’s release to enable him to celebrate Eid at home.
He said that all legitimate nomination forms can only be obtained through the party’s official national secretariat.
Mr Abdulmalik then asked the defendant to identify his lawyer, and Mr Chidiebere pointed at Mr Balogun.
The plaintiffs contended that despite meeting these requirements, INEC failed to register the association within the timeframe provided by law.
The judge said granting the forfeiture order does not disturb the likely outcome of the appeal.
