The claimants had earlier filed an ex parte application, seeking judicial review in suit No. LD/9134GCM/2025.
The case was adjourned until December 9 for continuation of trial.
The defendant, however, pleaded not guilty to the charge.
The prosecution told the court that Evans was already facing five different criminal cases related to kidnapping and murder and had been convicted in two of them.
Mr Shittu, in his application, sought the court to quash the DPP’s legal advice, citing an alleged lack of a fair hearing.
Justice Matthias Dawodu said the application in question was not in the file.
Mr Obasa is challenging the allegations that led to his initial removal as speaker, which include fraud, high-handedness, abuse of office, and gross misconduct.
The defendants were arraigned on June 21, 2024 and each pleaded not guilty to the charge.
