The decision, according to Mr Orizu, followed an intervention during Tuesday’s plenary by the deputy speaker, Benjamin Kalu.
The judge, who said that the case had taken three adjournments due to no representation, consequently struck out the case.
“I hereby recuse myself from this case and remit the file to the chief judge for further necessary action,” Ms Nyako stated.
The judge adjourned the matter after Mr Kanu’s counsel, Alloy Ejimakor, indicated his interest in responding to a counter affidavit jointly filed by the SSS.
Mr Kalu hinted that arrangements were ongoing to ensure the separatist, who had been agitating for a Biafra nation, regains his freedom from jail.
The Supreme Court of Nigeria has upheld the treasonable charge against Nnamdi Kanu, the leader of the proscribed Indigenous People of Biafra (IPOB).
“This is an absolute disgrace,” Mr Powerful stressed.
The regime is opposed to Nnamdi Kanu’s release, fearing that “he may not be available to face his charges in court because he had already jumped bail before.”
Mr Kanu, who expressed dissatisfaction with the judgement, has proposed challenging it on appeal.
