Mr Usman alleged that his client, a Muslim, had not been allowed to go for his prayer since he was detained by the SSS.
The case, which was filed on Thursday, has not been assigned to a judge.
On Thursday, the Abuja Division of the Federal High Court affirmed the nomination and substitution of Kadiri Asamah as the Labour Party’s deputy governorship candidate.
“I am going to allow the defendant to have access to his own physicians, and whatever they do will be under the supervision of the prosecution,” the judge ruled.
Mr Kasim filed the petition on the grounds that Mr Wanchiko was not qualified to contest the poll.
The court held that the petitioners (Mr Magaji and PDP) failed to prove their case on the preponderance of evidence.
The tribunal set aside the Certificate of Return issued to Mr Gana and ordered a supplementary election in the 26 polling units within 90 days.
The former Rivers governor had filed a suit to seek a court order to stop PDP from taking action against him without a fair hearing.
“We have said that there is no threat to suspend the applicant, and the onus is on him to prove this.”
On Tuesday, the Abuja Division of the Federal High Court extended the order restraining PDP from suspending or expelling Mr Nyesom from the party.
