He told an Abuja High Court that Mr Mustapha must be in court to answer for the alleged $6.23 million CBN loot.
Mr Oyedepo told the court that based on the plea bargain talks between parties, the prosecution filed an amended charge.
The judge subsequently adjourned the case until January 29, 2026 for continuation of hearing.
On Tuesday, the FCT High Court adjourned until October 21 to continue the trial of ex-CBN governor Godwin Emefiele over alleged procurement fraud.
The anti-graft agency accused Mr Emefiele of unlawfully approving the withdrawal of N124.8 billion from the Consolidated Revenue Fund of the Federation.

The police and SSS have been restrained from arresting the spokesperson for the Social Democratic Party (SDP), Faruk Adejoh-Audu.
The suspended CBN governor was accused of conferring corrupt advantages on a staff of CBN, Ms Yaro, through awards of vehicle supply contracts worth over N1.2 billion.
Mr Emefiele is expected to remain in Kuje Correctional Centre pending when he meets the bail conditions.
