The judge on January 9 ordered the minister and the AGF to appear before him.
Dangote Refinery sought N100 billion in damages against NMDPRA for its continued issuance of import licences to NNPCL and the five companies.
The plaintiff filed the application through a team of lawyers led by Paul Atayi.
The judge said, “The application is hereby granted as prayed.’’
Mr Kanu had sued the Federal Republic of Nigeria and the Attorney-General of the Federation (AGF) as first and second defendants in the suit.
Mr Ayuba, the fifth prosecution witness, said the N416 million received in tranches was returned as $1.137 million equivalent.
The case was subsequently fixed for November 25 for commencement of trial.
Justice Inyang Ekwo, in a ruling, dismissed the suit on the ground that the suit was statute-barred.
He, however, refused to grant a relief seeking compensation in the sum of N1 billion against the defendants.
The judge further held that the group is not a juristic person as the issue brought before the court bordered on the internal affairs of the APC.
