Ms Nyako held that Mr Kanu was constitutionally entitled to have access to both the records he requested and medical doctors of his choice.
The matter, billed to be heard today, was adjourned till June 20 by the court registrar following the absence of Justice Binta Nyako in court.
The apex court ordered that the suit instituted by Jimi Lawal, a governorship aspirant, be remitted to the Federal High Court for a fresh trial.
“There is no need to panic; all is well. We will certainly appeal the judgment and so let us maintain the peace as all hope is not lost.”
Justice Taiwo Taiwo, in a judgment, dismissed the suit for lacking in merit and substance.
Justice Donatus Okorowo, who fixed the date, said though the judgment was earlier scheduled for Wednesday, it was not ready.
The sacked lawmakers comprised 18 members from the State House of Assembly and two from the House of Representatives.
“I am not aware of any court judgement sacking me or any member because we have not been served with any court order.”
Delivering judgment, Justice Taiwo Taiwo said, “We cannot continue in sin and expect grace to abound.”
The former head of service and others are being charged by the EFCC for fraud to the tune of N570 million.
