Speaker of the assembly, Martins Amaewhule, presided over the plenary to remove Mr Fubara as governor in televised proceedings on Thursday.
The appellate court said that Mr Fubara had withdrawn his counter-affidavit at the Federal High Court.
Mr Oko-Jumbo said that the 2024 budget of the state was validly presented and passed into law.
Mr Fubara presented the 2024 budget when his current Chief of Staff, Edison Ehie, emerged as the speaker.
Mr Oko-Jumbo, the speaker of the assembly’s faction loyal to Governor Siminalayi Fubara, disclosed this during a house sitting on Friday.
He urged the public to disregard the report as it was misleading.
The police command, however, said the deployment of personnel to the assembly quarters was to uphold peace, not partisan interest.
“We made sure we did not do anything outside the 1999 Constitution.’’
The court adjourned until November 27 for hearing.
The police commissioner described what happened at the speaker’s residence as a routine police patrol.
