Mr Fubara had presented the 2024 budget to a four-member House of Assembly.
The appellate court said that Mr Fubara had withdrawn his counter-affidavit at the Federal High Court.
Mr Ada-George commended residents of the state for their active participation and peaceful conduct during the elections.

The governor promised that the tenure of the caretaker committee chairmen of the 23 LG would not be long.
The governor urged the new caretaker chairmen to protect the interests of their people.
