The Federal High Court, Abuja Division, on Thursday struck out the criminal charge filed by FCCPC against MTN and its executives.
The judge, who said that the case had taken three adjournments due to no representation, consequently struck out the case.
He held that only INEC could initiate and maintain criminal proceedings for offences under the Electoral Act, 2022.
On Thursday, the Federal High Court, Lagos Division, declined the arraignment of Ezekiel Onyedikachukwu, a former manager of gospel singer Mercy Chinwo.

The court, however, ruled that the victim is not a minor before adjourning the matter till early August.
The brothers were sentenced to seven years imprisonment each for conspiracy and 10 years each for rape, without an option of fine.
