An Akure Magistrates’ Court on Tuesday remanded one Emeka Chukwu, 37, at the Olokuta Correctional Centre for an alleged attempt to rape a nine-year-old girl.

Earlier, the prosecutor, Inspector Augustine Omhenimhen, told the court that the defendant on April 10, at the Asiwi Community, Akure allegedly tried to defile the minor by rubbing her private part indecently.

He added that the offence is contrary to and punishable under Section 218 of the Criminal Code Cap 37 Vol. 1, Laws of Ondo State of Nigeria, 2006.

The prosecutor appealed to the court to remand the defendant at the Olokuta Correctional Centre pending the Department of Public Prosecution (DPP’s) advice.

However, the defence counsel, J. O Benard objected the remand application, saying that the medical report attached to the application could not give sufficient fact for the application to be granted.

Benard said there was no basis to suffer an innocent person on a mere allegation.

The Court’s Magistrate, Taiwo Lebi, ruled on the remand application of the prosecutor.

He adjourned the case to July 30, pending the outcome of the legal advice from the DPP.
