Court orders three-month wait for divorcee before entering new relationship
The Chief Magistrates’ Court in Mararaba, Nasarawa, on Wednesday confirmed a single divorce pronouncement (talaq) to a woman, Hauwa Usman.
Ms Usman’s husband, Habib Adamu, had earlier pronounced the talaq based on mutual agreement.
The judge, Mohammed Shomo, said the divorce was granted because all efforts made so far for reconciliation and negotiations failed.
“The divorce was granted based on mutual agreement between the two parties as well as custody given without prejudice,” he said.
The judge told Ms Usman to observe the three-month waiting period (‘Iddah) according to Islamic law.
Ms Usman had filed a divorce petition against Mr Adamu on grounds of neglect while demanding custody of their child. She told the court that she had been responsible for the well-being of their child for five years.
Mr Adamu admitted to the petitioner’s allegation.
The judge had given the couple two weeks to settle the matter amicably before dissolving the marriage.
