Court to rule on Secondus’ suit to stop PDP Convention

The Port Harcourt Division of the Court of Appeal will on Friday give a ruling on the matter filed by the embattled chairman of the Peoples Democratic Party, Uche Secondus, against his party and 10 others.

Mr Secondus in suit number CA/PH/339/2021 is appealing to the court to restrain the PDP from holding its national convention, scheduled for October 30 to 31, 2021.

A three man-panel led by Justice Haruna Tsammani, adjourned the case to Friday, following a two hours argument on Wednesday by counsels of both parties.

Tayo Oyetibo, counsel to Mr Secondus prayed the court to grant Secondus’ appeal, stating that the right of the appellant will be permanently destroyed, should it not be granted.

Mr Oyetibo, a senior advocate, noted his client (Secondus) had complained to the court for his illegal removal as the PDP chairman while his tenure will be due in December 2021.

He, however, urged the court to preserve the case, “having regard in the jurisdiction of the court to be able to give efficient judgment in the main appeal”.

Counsels to the respondents, Henry Bello, and S.I Ameh separately demanded that the court dismiss the case.

Mr Bello explained that a counter affidavit of 24 paragraphs sworn by the first respondent was filed on October 28, which he urged the court to award the applicant cost. He argued the application is a radical departure on the rest of the appeal.

Mr Tsammani, while appreciating the cooperation of both parties, warned the media to desist from dishing wrong information to the public. He pointed at the trending reports stating the court has stopped the forthcoming convention of the PDP.

The Degema Division of the Rivers State High Court had suspended Mr Secondus in August after a party chieftain Ernest Ibeawuchi and others sought an interim injunction of the court to prevent the PDP leader from parading himself as national chairman of the PDP.
