Man remanded for giving fake address in court

The court heard that the defendant conspired with others, now at large, to pervert the course of justice.

Magistrate A.O. Famuyide of the Ile-Ife Magistrates’ Court has ordered the remand of Eruteya Moses, 47, at Ile-Ife Custodial Centre for misleading the court through a fake address.

The magistrate gave the order on Thursday after the police arraigned Mr Eruteya for allegedly perverting the course of justice.

Police prosecutor Adesina Elijah told the court that the defendant committed the offence on March 30, around 12:00 noon at Magistrates’ Court IV, Ile-Ife.

The court heard that the defendant conspired with others, now at large, to pervert the course of justice. 

Mr Adesina added that the defendant perfected and obstructed the course of justice when he misled the court by using a fake address for the purpose of bail.

The prosecutor said that the defendant allowed one Adekunle Tunde, standing trial in a suit No: MIF/108c/2022 to jump bail.

He further stated that the defendant, by his action, had forestalled court proceedings since May 13, having the knowledge and consent that it was an offence.

According to Mr Adesina, the offences contravene Sections 126 and 516 of the Criminal Code, Laws of Osun, 2002.

The defendant, however, pleaded not guilty to the two-count charge of conspiracy and misleading.

The defence counsel, Ajibola Famoriyo, pleaded the court to grant his client bail in the most liberal term, pledging that he would not jump bail, but would provide reliable sureties.

The magistrate, however, refused to grant the defendant bail, but asked the defence counsel to come with a formal application.

Ms Famuyide, thereafter, adjourned the case till July 8, for mention.
