Supreme Court disqualifies PDP’s Imo West senatorial candidate

Following the Supreme Court judgement, the Peoples Democratic Party (PDP) will not have a candidate for the Imo West senatorial District in the February 25 parliamentary election.
On Friday, the apex court nullified the party’s primary election, which produced Jones Onyerere as its candidate.
Justice Emmanuel Agim gave the judgement following an appeal filed by Nnamdi Ezeani.
Mr Ezeani had complained that the PDP violated section 87 (9) of the Electoral Act by conducting the primary election outside the main venue stipulated by law.
The Supreme Court cancelled the primary on the ground that it was conducted in Owerri, Imo capital, instead of Orlu, the Senatorial headquarters of Imo West.
The court held that the PDP would not participate in the senatorial election, failing to produce its candidate within the time allowed by law.
According to the judgment, since the time for the party to pick a candidate was already over, it was deemed that the PDP would not have a flag bearer in the February 25 poll.
Mr Agim warned the parties always to conduct their affairs within the ambit of the law, adding that section 87 (9) of the Electoral Act is clear on where primary election should be conducted.
