Responding, defence counsel, E. E. Ekere, said he was unaware of the allegations raised by the prosecution.
The police, also in its counter affidavit deposed to by Inspector Ewa Anthony, argued that it had the statutory power to detect, arrest, investigate and prosecute offenders.
Mr El-Rufai is scheduled to take his plea before Justice Joyce Abdulmalik in the court on a three-count charge.
Mr El-Rufai’s aide noted that the SSS committed flaws bordering on incompetence, non-disclosure of the offence and gross abuse of the court process.
The State Security Service will on Wednesday, arraign former Governor Nasir El-Rufai for cybercrime and breach of national security.
He added, “I am further directed to state that the allegation has been formally referred to the Department of State Services for a comprehensive investigation.”
Mr El-Rufai said, ““If anybody is to be asked questions about the disappearance of Dadiyata, it’s the Kano State government.”
“There is no sense in what he (Mr Baba-Ahmed) said. It is absolute nonsense,” Mr Atiku’s spokesman told Peoples Gazette.
