Mr Tijani, in the originating summons filed on June 4, named Ms Kingibe, ADC, and INEC as the first to third defendants, respectively, in the suit marked FHC/ABJ/CS/1170/2026.
The court held that issues relating to discipline and suspension within a political party remain the internal affairs of the party and do not require judicial intervention.
Ms Kingibe, who represents the Federal Capital Territory in the Senate, was suspended indefinitely by the ADC Wuse ward chapter.
The judge granted an order directing the Wuse ward executive committee of the African Democratic Congress to serve Senator Ireti Kingibe court documents by substituted means.
Mr Aduda in a letter on Tuesday said his resignation followed a protracted crisis rocking the opposition party.
The defections were made known during Senate plenary on Thursday.
Ms Kingibe claimed the provision was only set aside for both the Senate and the House of Representatives to harmonise the section.
“Ordinarily, we shouldn’t have issues with payment if the FCT minister hadn’t stopped it. We’ve written an open letter to President Bola Tinubu to intervene,” Mr Mosuwa said.
She said that her defection would strengthen the ADC’s footing in the FCT ahead of the February 2026 Area Council elections.
The senator stated that for a land to be revoked, there were non-negotiable protocols to be observed.
