Ms Kingibe claimed the provision was only set aside for both the Senate and the House of Representatives to harmonise the section.
According to him, politicians sometimes exploit security to intimidate voters for selfish ends.
The REC said the level of turnout during the voters’ registration exercise indicated that the electorate is anxious to participate in the election.
“For the avoidance of doubt, presiding officers, and not APO1s, are responsible for result upload to the IReV. All the passwords have been securely released.”
INEC says its results viewing portal is to enhance election transparency and not a result collation or transmission system.
The tribunal led by Justice Oken Inneh had reserved judgment following the adoption of written addresses by both parties on August 13.
Justice Ezekiel Ajayi, the chairman of the three-man panel, reserved the judgment after counsels to the petitioner and respondents adopted their final written addresses.
He also argued that the Electoral Act did not mandate the use of IREV, only that of BVAS machine.
Justice Haruna Tsammani, chairman of the five-member panel of the court, adjourned hearing in the petition until Tuesday.
“I find it slightly difficult to understand why they are relying on the results from the IREV.”
