Two men arraigned over alleged assault, breach of peace

Two men, Jacob Afiwajoye, 65 and Segun Olanigan, 45, on Thursday, were brought before an Okitipupa Chief Magistrates’ Court in Ondo State, for alleged assault and causing breach of the peace.
The defendants, a farmer and trader, whose addresses were not provided, are facing a three-count charge of assault, misdemeanour and breach of the peace
The Prosecutor, ASP Zedekiah Orogbemi, told the court that the defendants on June 29, at 10:00 a.m. at Okunmo in Okitipupa, Okitipupa Magisterial District, conspired to commit assault and misdemeanour.
Mr Orogbemi alleged that following a misunderstanding, the defendants pummeled to a pulp, the complainants, Messrs Posi Olowofoyeku and Joel Oladipo.
The prosecutor further alleged that the defendants also caused a breach of the peace through their actions.
Mr Orogbemi said that the offences committed contravened sections 355, 517 and 249(d) of the Criminal Code, Cap.37, Vol. 1, Law of Ondo State, 2006.
The defendants, however, pleaded not guilty to the charges.
The Chief Magistrate, Philip Akinlosetu, granted the defendants bail in the sum of N200,000 each and one surety each in like sum.
He held that the sureties must reside within the court’s jurisdiction and should show evidence of two years tax payment to the Ondo State government as part of the bail conditions.
Mr Akinlosetu adjourned the case until December 5 for further hearing.
