Ominikoron is standing trial before a Lagos State High Court at Tafawa Balewa Square on a count charge of murder.
The Lagos State government had accused the BRT driver of the rape and murder of a 22-year-old fashion designer, Ms Ayanwole.
Mr Omotubora, however, told the court that the application for a no-case submission was at the filing stage.
The pathologist also said there was a fracture on the bone above the ear, and bruises were also found on both lips of the deceased.
On Wednesday, the court’s registrar told Peoples Gazette that the judge was absent due to health reasons.
The defence counsel argued that there’s a possibility his client’s confessional statement was falsified or forcefully obtained.
Justice Sherifat Sonaike of the Tafawa Balewa Square Division of the Lagos State High Court, adjourned the matter till September 29.
Andrew Ominnikoron is charged before a Lagos High Court, Tafawa Balewa Square, on five counts bordering on conspiracy, rape and murder.
