On Thursday, Justice Inyang Ekwo dismissed the suit after counsel for the NDLEA, Joseph Sunday, prayed the court that the matter be struck out.
The former Imo governor now senator is expected to be arraigned on a 17-count money laundering charge by the anti-graft agency.
The EFCC had, in the 16-count charge, accused the ex-minister and others of unlawful and criminal misappropriation of N715 million.
The judge held that the 36 states’ attorneys general, who instituted the suit, had no locus standi to file the matter.
Mr Minimah and his co-plaintiffs are challenging the validity of a criminal charge instituted against them by the EFCC.

Mr Umahi had on Tuesday attacked Justice Inyang Ekwo, accusing him of carrying out “hatchet job”.
