Justice James Omotosho held that Mr Kanu failed to provide credible evidence to back the defendants’ alleged violation of his fundamental rights.
The judge held that there was sufficient evidence to show that Mr Ighodalo won the primary.
The MultiChoice official described NBC’s action as an abuse of power and urged the court to grant their plea in the interest of justice.
“The name Joe Odey Agi, SAN, is not on the roll of legal practitioners in Nigeria. What exists on the roll is Agi Joseph Odey, year of call, 1985,” court heard.
Mr Benye said the instant suit was an abuse of court process.
The judge further held that assuming without conceding that the plaintiffs had locus standi, he wondered if instituting the action was the right course of action.
“The name Joe Odey Agi, SAN, is not on the roll of Legal Practitioners in Nigeria.”
Mr Shaibu, through his lawyer, Oladoyin Awoyale, said the panel’s sitting to investigate him would amount to fait accompli.
“Today, we are just seeking leave to serve the parties by substituted means. So, can this court grant this? The answer is no,” the judge said.
