Mr Gombe had written a letter to the chief judge of the Federal High Court on May 4, requesting that the case be transferred to another judge.
Justice Emeka Nwite said that, though the facts of the case were not in dispute, it was glaringly clear that an appeal had been entered at the apex court.
Justice Nwite adjourned the matter until March 7 for continuation of trial.
Binance is the sole defendant in EFCC’s amended charge dated and filed on November 25.
The court on Wednesday ordered that the EFCC should be issued a warrant for Mr Bello’s arrest.
