Lawyer seeks stronger cybersecurity, data protection laws

An Ibadan-based legal practitioner, Olakunle Akintola, has stressed the need to regularly update Nigeria’s data protection and cybersecurity laws to tackle emerging technological threats.

Mr Akintola said this in an interview with journalists on Saturday in Ibadan.

He said that although Nigeria has a fairly strong legal framework, rapid technological changes require laws to remain flexible and responsive to new threats and innovations.

Mr Akintola, a former secretary of the Nigerian Bar Association (NBA), Ibadan Branch, called for regular review of the Cybercrimes Act and the Nigeria Data Protection Act to address gaps.

He also urged the creation of an expert advisory panel comprising legal professionals, cybersecurity experts, technologists and industry stakeholders to guide lawmakers on emerging trends.

The lawyer further recommended the ratification and domestication of more international treaties on cybercrime and data protection, as well as the pursuit of bilateral and multilateral agreements for legal assistance.

He added that clear legal frameworks should be developed for cross-border data transfers.

Mr Akintola stressed the need to ensure adequate protection of Nigerians’ data when processed abroad and vice versa.

He also urged stronger enforcement capacity and improved institutional mechanisms for effective implementation of relevant laws.

“By updating legal frameworks, strengthening enforcement and promoting digital responsibility, Nigeria can address challenges posed by emerging technologies.

“This will help safeguard national security and protect citizens’ rights in the digital age.

“Nigeria’s regulatory framework has improved, from the Nigeria Data Protection Regulation 2019 to the Cybercrimes Act 2015 and the Nigeria Data Protection Act 2023.

“However, there is a need for continuous improvement to address emerging issues,” he said.

Mr Akintola also said that the amendment of the Nigeria Police Act marked a shift towards a service-oriented and rights-based policing system.

According to him, the amendment shows a move from a force-driven approach to one centred on human rights.

He noted that it aims to create a more accountable, professional and rights-compliant police service, promoting democratic policing.

Mr Akintola added that the development marks a significant step towards a more responsive and professional police force that respects citizens’ rights.
