U.S. court dismisses Trump racketeering case over attempt to overturn 2020 election result

The case against Mr Trump stemmed from attempts to change the results of 2020 presidential election results in Georgia.

A court in the United States on Wednesday dismissed the historic racketeering case against President Donald Trump over his efforts with other alleged conspirators to overturn the 2020 presidential election after his loss to his predecessor, Joe Biden.

This came after Georgia prosecutor Pete Skandalakis filed a motion at the Fulton County Superior Court asking Judge Scott McAfee to dismiss the case, citing various legal challenges tied to a successful trial, including presidential immunity and jurisdiction.

“Given the complexity of the legal issues at hand — ranging from constitutional questions and the Supremacy Clause to immunity, jurisdiction, venue, speedy-trial concerns, and access to federal records — and even assuming each of these issues were resolved in the State’s favour, bringing this case before a jury in 2029, 2030, or even 2031 would be nothing short of a remarkable feat,” Mr Skandalakis said.

The case against Mr Trump and 18 other co-defendants, including his former lawyer Rudolph Giuliani, stemmed from attempts to change the results of 2020 presidential election results in Georgia with the American leader recorded during a phone conversation pressuring state electoral officials to find him 11,780 votes that would have allowed him to flip Mr Biden’s win.

He was subsequently indicted by a grand jury in Fulton County in 2023, becoming the first former United States President to be criminally charged in a case that captured global headlines. However, prosecutors have failed to make any progress in the case after Mr Trump won the presidential election a year later.

In his ruling, the court agreed to dismiss the case that was deemed the most severe legal threat Mr Trump was facing because state criminal convictions are not subject to presidential pardon.

It is the third criminal case against the president to be dropped since he returned to the White House after his instigation of January 6 Capitol riot and manhandling of classified documents proceedings were earlier discontinued.
